| Mine did this occasionally, I mostly avoided it by not tightening the cap all the way. It makes enough contact to work pretty early, so you should be okay.
My thought is this is due to some paint flaking off somewhere that shouldn't, or perhaps a contact getting bent. Cleaning would be a good bet, otherwise you may be stuck buying a new pen. Definitely don't want to let it sit heating too long, shorted out batteries can be a Bad Thing.
