A new 6/1 Comp-USA memo has been circulated to all Comp-USA stores requiring all purchasers of an I-Opener product to sign an agreement enforcing their new TOS including a requirement to use their ISP service. This, according to the memo, covers all backordered as well as future purchases.

Customers who feel that the TOS should not have applied to them because of the time they purchased the unit (prior to the TOS) will be offered a full refund and their order will be canceled. Comp-USA's legal department feels that the refund policy protects them from any consumer law issues in that they are not charging any fee to cancel the order and obtain a refund.

Store managers are being advised not to release units without the signed agreement. Evidently, a large shipment for Comp-USA backorders was being held by Netpliance until Comp-USA agreed to the new TOS policy.

Not charging a fee to do a refund when they do a bait and switch? Hoo Boy! That's rich! Tell them that you are doing them a favor by not reporting them to the consumer fraud unit in the state where you live and will they please now give you what you ordered.

Well my lawyer feels that a FTC and Atty General complaint is in order. I think my lawyer is not biased because he is not paid by compUSA.
I think I am getting better legal advice than compUSA because the kissass syndrome is not in place.
I don't think it would be a big thing to apply for that $1000 per order you can get for them not giving you what was paid for. It's probably a two page fill in form.

For those who will get this call in Massachusetts, you should know that before you institute legal action in the state, you should file the following <a href="http://www.state.ma.us/consumer/Pubs/demand.htm">demand letter</a>.
The applicable document to site is <a href="http://www.state.ma.us/consumer/Pubs/shop.htm">this one</a>. In particular, the section that reads:

TRUTH IN ADVERTISING AND SALES


Disclosure:
Under state law, a merchant must tell you about any fact that may influence your decision to enter into the transaction. For
example, a used car dealer would have to disclose that a vehicle was in a serious accident
(940 CMR 3.16(2)).

is probably very applicable here.

Anybody sat down and calculated the cost that someone who actually would PAY for this TOS? I think it was what, $20-something a month for service, times 3 years (36 months) plus the $99 for the IO? Gotta be out of their minds. $500+ for an IO? Which will be outdated several times over by the time you walk out the door with one.

That, my friends, is dumb.

Baaa!
