I got my CompUSA prepaid IO today without TOS

I prepaid on 4/27 at CompUSA located at Marsh & Beltine, (Addison) Dallas TX.
As everyone knows, this turned to a hassle CompUSA trying to force the TOS.
In the past weeks I talked to couple different managers, called the corporate
office and no go. They were not giving me the IO, unless I signed for the service.
Today I gave up on waiting and hoping. I went to get my money back (and purchase
Diablo II). I got to the service desk and asked If I can get the IO without the TOS,
or give me my money back. The kid was not familiar with how to refund, so he went to
ask help. Few minutes later the kid came back carrying the IO followed by their
operational manager (Peter)
He said he had been at their corporate office TODAY and they had told him to release
the prepaid IOs WITHOUT the TOS. Well, I took the IO and shelled some more money for
the Diablo II. Happy camper now.

I picked my pre-paid (3-31) I-Opener today from Crapusa in Ballwin, Mo.....no TOS ...no sweat. They had previously refused to hand it over four times in the last month since they came in. Get over to the store quick before they run out....or change their policy again. My opinion of CrapUSA remains the same, however. My opinion of the lamer newman, and his moran alter-egos, also remains unchanged.

likewise a machine in the Boston area. took the poor droid about 20 min to figure out how to sell it, but he did so with no problem in a very courteous manner - credit where credit is due. they still have the demo machine up, wonder what they are going to do now that npli is doing their $400 pillage. their web page still sez $99 w/ a in store activation.

By no TOS do you mean no TOS enforced by Comp USA? The box reads breaking the seal authorizes release of your name and what not to Netpliance. I wonder does Comp USA or CC forward the names of all purchasers to Netpliance?

Ahhh...But do you not remember... The statement made by the Netpliance Director of marketing to a respected Internet news media.....Regarding purchases made prior to 3-31-00 not falling under the new terms of service established april fools day (4-1-00)....

anyhoo, given this latest debacle, i am sure that they will make the all stars at "####edcompany.com". At $400, they are not making money, but won't sell them either. At $200 or less, they will sell them, but folks will rip them apart. BAAAAAD BUSINESS MODEL. Should have done it the way Virgin did it with a lease model. O well...

No spunk on the bios, other than that haven't looked.

"Implied consent" probably won't cut it if you didn't sign anything. Your transaction is with CUSA, not NPI.

so open the side then... anyway, it is highly doubtful that the seal is anything but fud. unless you bought it directly from NPLI, the transaction is, as has been stated, between you and cc or comupa. since neither of them have explicitly stated that there is a TOS attached to the purchase from them, i doubt that any court would uphold it. since you have not authorized NPLI to charge your credit card, any charge by them would constitute fraud IMHO. Enough disputes and chargebacks, and the credit card company will tell them to buzz off. that would be the kiss of death for a company that is relying on charging cards to get their revenue

Similar incident here, in sunny Corpus Christi, Texas. Bought one last week, no TOS but the box had the Sticker of Doom on it. Got the unit home, unpacked it, then got nervous about the fact that CircuitCity had my card number, etc. Took the unit back the next day, took a $15 hit on a restocking fee, and waited.

Yesterday I went in and bought another unit (seems they only have 1 in stock at any given time), paid cash, gave bogus name/address info, picked the unit up at the customer disservice counter, and walked out the door. No TOS, box had the Sticker of Doom on top and bottom, but now it's mine, all mine! LOL. I cut around the sticker while opening the box just so the seal remained (technically) intact.

Oh well. Gonna have to get one or two more before these things go way up in price.

BTW, this unit has no goop on the BIOS, no clipped pins on the IDE connector, so I should be able to work with it.

anyway, consider the following: the sticker sez that you have to open an account with NPLI and stay around for 3 months. OK, I've done that (I bought one from NPLI direct as a lark and paid up for 3 months up front). Sticker doesn't say that I have to open an account for each one I bought. After all, you know how these things are, horribly unreliable. Have to make sure that I have at least 5 for backup just in case... Getting their weather report is mission critical and all you know

Chances are that NPIL is shipping all of their boxes with these stickers. Probably applied in the Far East or perhaps in Alaska.

If these were sufficient to tie one to a TOS, do you think that CUSA would have gone thru the dance to force customers to sign up in the store?

As several people have previously noted, unless your have ordered from NPIL, your transaction is with CUSA and/or Circuit City.

NPIL appears to be trying to figure out a viable business model. It seems unlikely that they will try to track down those that broke the seals on units from CUSA and Circuit City. Hey, what about the investment or collectable value of an I/O still in the box with the seal unbroken a few years from now? That would be a valid reason for purchasing it at this point -- or at least as good as many other reasons!
