Gives people a good long time to reconsider, even after they do order...

So I take it that we are all safe then, no more tos. Just because we bought it doesn't commit us to anything unless we signed a contract. I take it that there will be a new version of the iopener?

400 might be a bit high and I would start looking at used laptops but I have had i-openers and they are sweet little units. With a bit of price pressure from competing Internet appliances I think we still have a fun area to play in.

I just picked one up 7/8.

Bought with credit card meaning they have my signature. BUT, the signature was only for authorizing the $99 + tax. Did not sign a TOS. The stickers on top and bottom of box say something like "If you break this seal, you are committed blah blah blah."

This is totally lame and because:
1. I did not sign a contract.
2. I could have opened the box from the side with a blade/knife - technically, I didn't break the seal (I know cheeky but still a technicallity)

I can say the above because startup dot-coms don't necessarily have the resources to make sure they cover their asses. I work for a high profile dot-com and often have to TEACH our legal department some technical things. I can totally see their legal writing the copy for the sticker and not looking at loopholes (i.e. ripping the sides)

If they really wanted to enforce the "you will pay the penalty if you don't sign up for at least 3 months blah blah blah" they would have to create a contract that buyers will have to sign along with the purchase. I verified the receipt I signed and it was strictly for the sale with no contracts.

Better get em before Netpliance wakes up and enforces the contract.

Hint: I got the email 3 days ago saying they were now in stock. Went to the Circuit City website - out of stock. I went to one store - not in stock - BUT they told me there were two pieces in a store a few miles away. I bought it at the first store and picked it up 20 minutes later. Bottom line? Go to a circuit city store and tell them to look it up in their database. Good luck all.

BTW. I don't know yet if the one I bought is hackable. I bought on pure faith that the hackers will come up with one

I found it a bit funny and ironic that the reciept I got a Circuit City described the IO as a "desktop computer" -- something that NPIL trys not to admit that it is!

It is my impression that Circuit City never wanted to play the TOS game and also resisted sending customer info to NPIL. In the absence of in-store registration, they probably aren't passing on the information.

You are right about the quality of NPIL's legal advice. If they have only spent $300,000.00 on R&D, I suspect that they also failed to budget sufficient funds on counsel. In something like this, it is better to pay the attorneys up front to avoid problems rather than to dig you out later. I am sure that when they tried to impose the TOS retroactively, they discoverd that they then had to spend some bucks on legal advice they should have gotten in the first place.

Again, the whole NPIL operation seems to be poorly run -- from choice of product design (easy to hack), to legal advice and now (with the $399.00 price) marketing. It looks like there is a lot of crisis response rather than longterm planning. If you read the press releases and comments to the press NPIL seems to be living in dreamland.

the legal folks for this firm have to be the biggest bunch of lamers i have ever seen. that and the folks who thought up the business model. the business schools will be studying this one for a long time as to how NOT to run a e-biz. the TOS for buying a i-opener is now no longer on their site that i can find. what is there is the stuff about i-opener 2001 membership agreement. ok, when you go to cc or compusa and buy one of these, you do not get the tos, when you go to their site you are buying a different product (a membership), thus the tos for that cannot extend to a different product. further, even under the old tos, you agreed to sign up for AN account. not one account for each of them that you bought (DOH!!). i have officially advised the buy who runs our hedge fund that this thing is a short even at 6.

I don't know if they changed the wording on the sticker, or if you misinterpretated it, but the sticker on the IO I just got, starts off like I stated in the Subject up there. So it doesn't matter 'how' you get into the box. All it says about the "seal" is "Do not accept if this seal is broken."

They did change the wording.

The sticker on the one(s) I picked up from Circuit City earlier this week starts out:

"By breaking this seal, you are agreeing . . ."

Not that the change will make a great deal of difference w/o a TOS signed at the time the sale was completed. From reading other posts, it seems that Netpliance now thinks they have fixed the machine and made it unhackable! Not so!
