I just got a call from netpliance informing me of the change in the service contract that I will have to commit to three months of service, and that the i-opener can no longer be modified. They have resorted to this. BEWARE!!!!!!!

They are running scared at the insistance of the lawyers. I suspect that part of this is to head off a i-opener trade in modified machines on ebay. Time will tell, but somehow I think that a cancel after 3 months will not require you to return the machine. Persoanlly, mine got run over by a large truck

Warning people of the change is the first reputable thing that they have done.

However, I think that you need to firmly tell them that you are not willing to accept any limitations or stipulations that were not presented to you at the time of sale. You should also tell them that that you do not want a modified unit.

Soooo...they plan to call everyone then? Even the people with orders outstanding at retail locations? Ludicrious. These people are loosing touch with reality. And what if I'm not available to answer the phone? Got to be kidding. I certainly hope everyone they've called already has stated that they do not accept any such changes to their terms of sale.

I called 1-800-IOPENER today (04/04/00) to try and get some details on my order. I placed my order online on 3/17. This was the third time I have called. It has still not shipped. The rep told me that they are going to be (supposedly starting today, Tues.04/04 -- He said he received the memo/instructions from his superiors today.) calling and e-mailing customers to get verbal approval to charge your credit card with the ISP fee 2 days after shipping. They are also using this call/e-mail to inform people who have ordered that this is a "newer model" (meaning NP took it apart and gobbed some glue around and cut a few pins.) He said, "Many people are cancelling their orders once we inform them it is a newer model -- they don't want it" -- I played dumb as to why they wouldn't want the 'newer version'. The rep said that most orders placed between 3/16 and 3/20 were going to get calls, since the website didn't have any agreement on it until then. All this info only applies to online orders direct from NP. All said and done, I verbally agreed to 90 days of their ISP service and he then informed me that pending orders as of now would be shipped out on Thursday(04/06), so I should receive my unit this Saturday. So, If you ordered online and are willing to pay the three months of ISP fees, if you call today and verbally agree to let them charge your credit card with the first month of ISP service, then it sounds like you'll get your unit on Saturday. I will reply to the I-Hacker BBS once I have a ship date and tracking number to confirm what the rep told me today. I know for a fact that some people will slip through the cracks, b/c I know of a few people who ordered right around when I did and they have received a unit. I'm one of the many that is stuck waiting. --cmf

I called NP to get the latest status on an order that was placed 3/16. The lady said that she had a statement that she needed to read to me regarding the "new and improved" terms and conditions. Which included accepting their NP service for a minimum of three months and if I canceled the service there would be a charge of $499.00 applied to my credit card. She gave me two options: (1) Cancel the order or (2) Agree to the new terms and conditions. She said that the order would not be shipped until I agreed to the TOC's.

I insisted that they send me the unit per the original terms that I agreed to and the response was "Sorry Sir". So I told her that I would have to get back to her......

Any suggestions? Anyone know any contributors to any major publications that would be willing to blast NP for poor business practices?

Ok, I've got questions...posted something about it on another thread, but still haven't gotten any feedback. Please consider what I'm asking here especially if you've agreed to the new TOS. Here's the thing(s):

First, what happened to all those email confirmations that the TOS does not apply to orders before 3/31? Let's assume for the next question that somehow they can just screw us and make us Agree or Cancel.

Second, and this is the important one, if we agree to the new TOS does NP OWN THE HARDWARE like it said on the web posting of the TOS?! I suppose I'd still pay if all they want is another $66 for the three months of service, if I can then cancel and keep the IO, and not get charged any futher. That is: $99 + $40 + $66 = $205 approximately. Still reasonably worth it to me. OR is it the case that after I cancel the service after three months I have to return the box or pay $499? Which is it? Has anyone asked a rep this yet?

Basically I want to know plain and simple, how much do they now want from you if you keep the box, whatever it takes? It's either: $99 + $40 + $66 = $205 or $499 + $40 + (at least) $22 = $550 and up

Does paying for the three months let me keep the machine without paying the $499 slam-fee? I'm not so sure (read the TOS on the web - it doesn't sound like there's any way to keep the box without paying the $499 fee). I don't want to agree to the damn 3 months if I don't even get the machine out of it.

If you don't know what I'm talking about, here's the part direct from the TOS:

"Netpliance grants to you a non-exclusive, non-transferable, revocable, limited license to use the Service Software. (Service Software includes all software, firmware, hardware and documentation related to the Service and the Device.)
...
You agree to return any and all copies of the Service Software and related documentation upon termination."

Notice it says you have to GIVE IT BACK if you terminate service! Seems to mean that if you can't return it in it's unopened condition (I heard something about seals on the "new version") for whatever reason, you pay $499. Be careful what you agree to! People have already been made promises that are getting broken left and right. Even if a rep says, oh yeah you needn't return it after 3 mo. who knows if they'll stick to that? I mean, we've got stuff in WRITING that they won't honor!

Come on loosers . Is anyone buying this crap. I called netpliance TWICE today. Neither time was I informed of the new TOS and both times I was informed of the Taiwan holidays. I even hinted to the new TOS and the woman simply said that only applied to new purchasers and did not include me.
SO CUT THE CRAP.

maybe you got lucky. I was told I would have to agree to 3 months or cancel. Talked to 'Phil') He didn't, however, say that the unit would have to be returned. I don't know, and to be honest, I'm too fed up to keep trying to do business with these people.

Honestly, I think we should all form some kind of synopsis of the business practices of Netpliance and show someone who cares.

People can scream all they want about Netpliance having the right to change things, but they can't change existing orders. That's just plain unethical.

Anyway, I'm done. I don't really have the time to mess with this low of a company.

Anyway, another thread has a lot of info on this, so check recent ones. It seems that uninformed reps are indeed telling people the new TOS applies to them. However, the REAL answer does seem to be that it only applies after 3/31 as people have gotten through to NP personnel a little higher up the foodchain and confirmed it. Expect this to become more clear after a little more time. Seems the reps are becomming as confused as everyone else. Again, it appears for the moment that they are sticking to the "TOS applies on or after 3/31 stance."

Apart from that, I'm also wondering about people who order on or after 3/31 (even though mine's ordered I'm trying to help - thought that's what the board was for). Are they effectively leasing the box or do they own it?

i ordered mine 3/16, tracking shows i ordered 3/17 - still hasn't shipped. i called three times, first time i was told i should see it last friday, second time i called a guy said the units ordered 3/16-3/20 period were recalled after manufacture, pre-ship because they were not programmed correctly for the service and that they would be going out soon, and i should have a tracking number by last friday. i called yesterday (4/4) and was told that it should ship on thursday because of taiwan holiday, and also repeating the bit about the recall... YET people are receiving units today that were ordered this week ! no one mentioned any new T&C to agree to or anything like that in any call, and my CC has still not been billed. i already spent $100 on mods... :(

The rumors are true, although the phone bitch I talked to said that it applied to all orders from 3/16 to 3/31. He said that I have to agree to 90 days worth of service or pay a $499 fee. I asked if I had to give it back after the 90 days if I cancelled, and he said no. I asked "so after 90 days I can cancel the service and that'll be that?" and he said yes. I asked if I actually had to use the service or just pay for it, he said just pay for it. Asked if there were any other charges besides what I had already payed for and he said no. Asked if the monthly charge was still 21.95 a month and he said yep. Asked if he felt like a bitch for working for such a ####ty company, he said, atleast I get to live in Austin.

Do what I did...Order ya IO with a Credit Card ya dont use that often, as soon as you get the unit call your CC company and tell them your wallet got stolen, they will issue a new account #. The lady at my CC company told me any pre-auths that came through my account, I would be called to authorize before they would allowed to be turned into actual charges. BTW I use Citibank.

Second; whhy do people believe everything they read here? If you are in doubt, call yourself, or beter yet, instead of instigating, just wait it out.

At this point, I'm thinking that as soon as I get mine, I'm going to call Netpliance and tell them _MY_ new TOS. Why should they be the only ones?

I can just imagine:

Me: Hi Netpliance, I just got my i-opener. I just need you to agree to my new TOS.

Netpliance: What are you talking about?

Me: Well, I figure if you can change the TOS without my signature, I can do the same without yours. So, lets see, you owe me $20 per month, including the time I had to wait for mine, plus a penalty for late delivery, plus a surchage for mental anguish, plus an extra fee for no reason at all. That comes to... um ... how much you got?

Netpliance: Click.

Hmm, Netpliance hung up on me. Maybe I should have done that when they called me. (Then called my lawyer).

The point is, no one is breaking the law. I have seen no proof that Netpliance has done anything wrong. All I have seen is a bunch of liars trying to prove each other wrong by telling more lies.
