I ordered on 20 Mar (black, phone order).

I was told the following when I called today:
- Orders between 16 and 20 Mar had no tracking numbers and had to be shipped "manually" and essentially have generally messed up tracking information. I've never heard this before and consider it suspect.
- He said that they have been authorized to _guarantee_ delivery on these orders by "Tuesday of next week" this translates to 11 Apr. Caveat: they could arrive at _any_ time between now and then.
- The new terms of service apply to my order because my card has not yet been charged.
- I told him I ordered under different terms of service and asked explicitly about cancellation penalties. He put me on hold and returned a few minutes later and stood his ground. *
- I gave him the gift story, and he suggested that I just transfer the service when I present the gift. When I stated that it would be a few months, he suggested I cancel and re-order.

At this point I figured that since I have now had someone tell me explicitly that the new terms apply to me, I would have a bureaucratic nightmare getting charges removed. While most non-negotiable contracts have little legal standing, they (correctly) bank on the fact that people are not going to go to the effort of going to court to dispute them.

I canceled. He said that if it should happen to arrive in the next few days (since he doesn't know where it is), to give them a call.

* "I don't know _why_ you would want to cancel your service."

I've talked to NP 5 times now about canceling my service, and each time I get a different story. One of my I-Openers is actually for a friend (his card is maxed out) and was ordered on another date than my own and is being shipped to a different address. When trying to cancel the service for this order (it really isn't mine) I have been told 3 times by different people that the service was canceled and that no charges would be made to my card. One person told me that I couldn't cancel my service until the order had shipped without canceling the entire order, and another person told me (Chris) that I couldn't cancel my service until the IP had arrived. (Obviously AFTER the charge is made, according to him 2 days after it ships) I plan to contest the charges on my card, (gotta love visa) they're not getting money for something I neither ordered (I ordered before the policy change) nor authorized. (I specifically told Chris that he nor Netpliance had permission to charge my card for a service I hadn't ordered.)

Wow, is this a headache. Where the hell do these people get off giving such radically different information out to people so indiscriminately? We've got people who've been emailed confirmations that the TOS don't apply to them, and now we hear this. I have no comprehension of how the new TOS can be applied to anyone ordering before 3/31, regardless of when the decide to bill you...especially when they are *late* in billing and shipping your item as promised originally. You simply *cannot* make up the damn policy as you go. This is so blatantly unprofessional...we've got to be able to do better than just bend over on this one. Who else has been hearing what? Please post what you've gotten from your reps.
