I am unsure about this and almost took a sh*t when I saw it. Netpliance has a NEW terms of service agreement that relly messes us up PLEASE READ it it you have not already <a href="https://secure.netpliance.com/store/terms_sale.asp">Terms and Conditions of Sale</a> the thing i am worried about is:
<b>Law.</b>
"This Agreement is the entire and complete understanding and contract between you and Netpliance. This agreement supersedes any prior agreements, written or oral, between you and Netpliance with respect to the subject matter of this Agreement. Any portion held invalid or unenforceable shall be construed as nearly as possible to reflect the original intentions of the parties, and the remaining portions will remain in effect. The Agreement will be governed by the laws of the State of Texas, without regard to its conflict of law rules. You consent to the exclusive subject matter jurisdiction, personal jurisdiction, and venue of the courts of the State of Texas with respect to all disputes arising out of this Agreement or the Service. Any cause of action you may have with respect to the service must be commenced within one year after the claim or cause of action arises or it is barred."
I ordered my I-Opener on 3/17/00, I did NOT get a copy of this, see this, and I was NOT told of this but according to what this says "This agreement supersedes any prior agreements" does this mean that no-matter what I am bound to/by this agreement? This has got to be in violation of some sort of law does't it? They can't just hold me to any contract they want when I was never made aware of ANY contract with Netpliance other than they send me computer (I-Opener) I give them money, right?
I beleave anything can be hacked but I am starting to think at what price...
