I received this email from IAN. Looks like they do expect us to return the webplayers...

-------
Dear Member,

Thank you for your continued interest in the Webplayer. We're very sorry
to inform you that the Webplayer and Internet service offer is being
discontinued effective 11/15/00. The Internet appliance and service
offering was supported by Internet Appliance Network (IAN), which is no
longer continuing in the business of delivering Internet appliances and
services direct to consumers.

SPECIAL OFFER:
To thank you for your participation in the charter member program, we
would like to offer you a $25 gift certificate to our preferred retailer,
Virginmega.com. To redeem your gift certificate, simply call the
Virginmega.com toll free phone number at: 1-877-484-7446.

You will be connected with a personal shopper who will be happy to
assist you in placing your order by phone. You may wish to visit
Virginmega.com ahead of time to browse music, video or DVD product.
Your gift certificate will expire on: 12/15/00 and is applicable toward your
next Virginmega.com purchase of music, video or DVD product. (Note:
see Rules at bottom of this email).

ABOUT YOUR MEMBERSHIP:
Internet Appliance Network will terminate your charter membership and
shut down the service as of midnight 11/15/00. Effective as of that date,
you are no longer bound by the terms of the Member Agreement. We will
send you a letter via US mail within the next 7-10 business days that
includes instructions for returning your Webplayer and a prepaid UPS
shipping label, so you can return the device free of charge. Your
Webplayer cannot be re-configured to work with another ISP.

We recommend that you notify your friends, colleagues and family that
your email address will no longer be accepting mail after 11/15/00 and
provide them with an alternate address. We also suggest that you
remove any remaining email from your mailbox prior to that date and
forward mail that you want to keep to an alternate email box.

Please be assured that we will delete from our databases all personal
information we've collected through the application and service, other
than your name and contact information (which we will keep as
necessary for record keeping purposes). If you still wish to receive
exclusive offers and discounts from Virginmega.com, send a message to
subscribe@virginmega.com to opt in.

Thank you for your participation in the charter program. We're sorry we're
not able to continue this service. For more information about the service
shutdown, click here.

through the toll free phone number provided. Offer is not

It sounds like they want you to return it but since they also say "you are no longer bound by the terms of the Member Agreement" you will not be changed if you don't return it. They are trying to induce you to return it of your own free will by giving you a free UPS return label and telling you it can not be used with other ISPs. If you were still legally bound they would have just said that in the letter and ordered you to return it.

"...will terminate your charter membership and shut down the service as of midnight 11/15/00. Effective as of that date, you are no longer bound by the terms of the Member Agreement."

So if you wait until 11/16 you're no longer bound by the terms...
unless they start reading here, that is.
