Circuit City requiring a TOS?
Got a new I-opener!!!

I just picked up my I-opener at Circuit City today. Had a sticker attached that said the same thing as the letter all of us recieved for our earlier I-openers. It says the "if you break this seal" bs we are used to. My question, is this legal? I signed no contract with Circuit City... However they do have my credit card, and the TOS says by breaking the seal I allow them to transfer my information. Netpliance is getting worse and worse. Granted, this is on the box, so it may have more legal standings then the letter. But I had already pre-paid a week ago, and just handed my reciept to pick it up. First things first, have to call Circuit City and make sure they don't transfer my information this time! ARGH!!!

Picked up mine from CC yesterday and can confirm the sticker on box. What a joke!

I figured out a way around it though: I'll just cut out the sticker and not break the seal! That way they'll never catch me.

I just hope the box isn't booby-trapped

Just called the 877 number for Netpliance. They confirmed that CC *do not* pass on details to them. You are expected to phone them and tell them your details directly.
As far as the sticker is concerned - open the other end of the box if it makes you feel better.

BTW - the salesman at CC is supposed to tell you about the TOS. Mine didnt...

I've just been paying cash for mine, and providing bogus name/addres/phone info. I've picked up 2 so far, and am debating whether to go back for another one. Still no TOSs, and the v4's I've been getting are nice - no goop or clipped IDE connectors.

I wonder if CC finally got in a huge order from NPLI? They're still $99 at my CC in south Texas.

CC has no record that you collected your iopener or for that matter any other product. When I went there they just handed me my back ordered IO at the counter. That is it. Moreover I paid by cash...

In the Tukwilla CC, the only way to get one is to order it on line using their "express pickup". It required a valid credit card. Bogus information and cash is not an option. Even though someone mentioned that CC doesn't provide info to netpliance, has anyone been contacted by netpliance over this TOS?

I did that on monday. The Lynnwood CC said they didn't really have the one the website said they did, but they'd get me one anyway. Paid cash, and walked out, no TOS required.

In the past week I have picked up several IO's from CC for a special project (no, not for ebay) ordered via the web. In no case was anything said about a TOS.

When I picked up the last one this evening, the woman who processed the order noted that it was a "desktop computer" and suggested I move my car to the pickup area so it could be loaded!
